Terms of Use

Effective date: October 26, 2026

These Terms of Use (together with our Privacy Policy, these “Terms”) describe the terms on which The New Hurricane Tour LLC, doing business as the Arnold Palmer Junior Golf Tour (“APJGT,” “we,” “our,” or “us”), offers (i) access to apjgt.com and any related subdomains and online services (the “Site”); (ii) registration for and participation in our junior golf tournaments and related programs (the “Tour”); and (iii) communications we send to you (together with the Site and the Tour, the “Services”).

Please read these Terms carefully. They constitute a legal agreement between APJGT and you. They contain a jury-trial waiver, a limitation of liability, an indemnity obligation, and other provisions that materially affect your rights.

By accessing or using the Services, including by creating an account, registering a junior golfer, or participating in a tournament, you affirm that you have read, understand, and agree to these Terms. If you do not agree, do not use the Services.

1. CHANGES TO THESE TERMS

The Effective Date of these Terms appears above. We may revise these Terms from time to time. If we make a material change, we will provide reasonable advance notice (for example, by email or by posting notice on the Site) before the change takes effect. We will not make a revision with retroactive effect unless we are legally required to do so or we need to do so to protect participants or the Services. Your continued use of the Services after the Effective Date of a revision constitutes your acceptance of the revised Terms.

2. ELIGIBILITY AND ACCOUNTS

Accounts for junior golfers must be created by a parent or legal guardian. To create an account, you must be a parent or legal guardian of the junior golfer being registered and at least eighteen (18) years old and otherwise legally competent to accept these Terms. By creating an account, you represent and warrant that you have full legal authority to register the junior golfer identified in the account, that you have provided any applicable parental consent, and that you are authorized to use the payment method you provide.

Children under 13 (COPPA). If the junior golfer you register is under thirteen (13) years of age, you are the child’s parent or legal guardian and, by creating the account, you consent to our collection, use, and sharing of the child’s personal information as described in our Privacy Policy. You may at any time review, delete, or refuse further collection of your child’s information through your account or by contacting us; please note that doing so may prevent the child from registering for or competing in our tournaments.

Account security. You are responsible for all activity under your account and for keeping your login credentials confidential. We may suspend or terminate your account without notice if we suspect any breach of security or any violation of these Terms. Please notify us promptly if you believe your account has been compromised or if you need to deactivate it.

Accurate information. You agree to provide accurate, current, and complete information when creating your account, registering a junior golfer, and submitting payment, and to keep that information up to date.

3. AUTHORITY TO REGISTER AND ACT AS AGENT

You represent and warrant to APJGT that you have full legal authority to complete each registration, including full authority to use the credit or debit card to which registration fees will be charged. If you are registering a third party, you represent and warrant that you have been duly authorized to act as agent on behalf of that person in performing the registration, and that these Terms apply equally to you and to any such person for whom you register.

4. ACADEMY COACH ACCESS

APJGT may offer a feature that allows an academy coach to view a junior golfer’s registration information and to register the junior golfer for events. An academy coach can access or register a child only after the child’s parent or legal guardian has specifically consented to that coach’s access through the account portal. The parent or legal guardian may revoke that consent at any time by removing the coach in the portal or by contacting us. APJGT is not responsible for actions taken by an academy coach within the scope of the access the parent or legal guardian has granted.

5. TOURNAMENT REGISTRATION AND PAYMENT

Entry fees and memberships. Entry fees, membership fees, and any add-ons (including add-ons purchased through the player dashboard such as push carts, digital yardage books, and competition entries) are quoted on the Site at the time of registration and are payable in advance. All memberships and add-ons are non-refundable and non-transferable. Event registrations are subject to the Withdrawal, Refund, and Transfer Policy in Section 7 below.

Payment processing by Stripe. Payments are processed by our third-party payment processor, Stripe, Inc. (“Stripe”). You enter your card information directly on a Stripe-hosted checkout, and your use of Stripe’s services is subject to Stripe’s own terms and privacy policy. By submitting a payment, you authorize APJGT and Stripe to charge the payment method you provide for the amount of the registration, membership, add-on, or other product you have selected, together with any applicable taxes and fees.

Billing descriptor. Charges will appear on your card statement as “ARNOLD PALMER JGT,” “APJGT,” or a similar descriptor. If you do not recognize a charge, please contact us at info@apjgt.com before disputing the charge with your card issuer.

Order acceptance. We may limit, decline, or cancel any registration at our sole discretion, including where a registration appears to be duplicative, fraudulent, or submitted after the registration deadline. If we cancel a registration you have paid for, we will refund or credit the amount paid in accordance with our Withdrawal, Refund, and Transfer Policy.

6. PARENTAL CONSENT, RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

NOTICE TO THE MINOR CHILD’S PARENT OR LEGAL GUARDIAN

READ THIS SECTION COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF APJGT USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY REGISTERING YOUR CHILD YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM APJGT IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO ACCEPT THIS AGREEMENT, AND APJGT HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT.

By registering a junior golfer and accepting these Terms, the parent or legal guardian (referred to below as “I” or “you”) acknowledges and agrees as follows:

  1. I understand the nature of competitive golf tournaments and believe the minor child (the “Minor”) to be qualified, in good health, and in proper physical condition to participate. I agree to instruct the Minor that if at any time the Minor believes conditions to be unsafe, the Minor will immediately discontinue participation.
  1. I fully understand that:

A. GOLF TOURNAMENTS INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH;

B. THESE RISKS AND DANGERS MAY BE CAUSED BY THE MINOR’S OWN ACTIONS OR INACTIONS, AS WELL AS THE ACTIONS OR INACTIONS OF OTHERS PARTICIPATING IN THE TOURNAMENT; AND

C. There may be other risks and social and economic losses not known to me or not readily foreseeable at this time, and I fully accept all such risks and all responsibility for losses, costs, and damages incurred as a result of the Minor’s participation.

  1. I willingly consent for the Minor identified in the account to participate in the Tour. I understand that tournaments will be supervised by APJGT employees, interns, or their designees.
  1. I release, discharge, and hold harmless APJGT and its parents, affiliates, officers, directors, agents, employees, interns, and designees, exercising reasonable care within the scope of their employment or engagement, from liability arising out of personal injuries and property damage resulting from or occurring during the Minor’s participation in the Tour.
  1. I have read these Terms, fully understand them, understand that I have given up substantial rights by accepting them, and have accepted them freely and without inducement or assurance of any nature. I intend them to be a complete and unconditional release of all liability to the greatest extent allowed by law. If any portion of these Terms is held to be invalid, the balance will continue in full force and effect.
  1. If, despite this release, I, the Minor, or anyone on the Minor’s behalf makes a claim against any of the parties released above, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS each of them from any litigation expenses, attorneys’ fees, loss, liability, damage, or cost any of them may incur as the result of any such claim.
  1. Media release. I authorize APJGT to release the Minor’s name, scores, round statistics, age division, home course or club, and photographs taken at events to junior-golf scoring services, college coaches, newspapers, golf publications, golf websites, golf organizations, and similar outlets, and to use the same in APJGT’s own publications, Site content, and marketing materials. I understand that payment is not provided for such use.

7. WITHDRAWAL, REFUND, AND TRANSFER POLICY

APJGT has a no-refund policy on all memberships and event registrations. The following Tour Credit and transfer policy applies to event registrations only. All withdrawal and transfer requests must be submitted in writing by email to info@apjgt.com. We will acknowledge your email within 48 hours. Include the player’s name, the event, the reason for withdrawal, and the option you are requesting. We cannot accept withdrawals by telephone. No exceptions.

  • Requests for Tour Credit or transfer received 13 or more days before the first round of the event will be honored for the full entry fee paid, less a $25 administration fee that APJGT may charge in its discretion.
  • Requests for Tour Credit or transfer received between 12 and 7 days before the first round of the event will be honored for 50% of the entry fee paid.
  • No Tour Credit or transfer will be issued if a player withdraws 6 days or fewer before the first round of the event. No exceptions.
  • Transfers may be requested up to 7 days before the first round. The replacement entry must be to a tournament of equal or lesser value, with the player responsible for any difference where the replacement is more expensive. Participants are limited to one transfer per calendar year.
  • If a player receives a Tour Credit and later re-enters the same event, the player must pay the registration price in effect at the time of re-entry.

Entire-event cancellation. If an entire event is cancelled and no golf is played, the player’s account will be credited in full for the event, less a $50 administration fee. If an event is shortened due to weather or other circumstances but at least one round is played, no refund or Tour Credit will be issued.

Memberships and add-ons. All memberships and add-ons (including push carts, digital yardage books, and long-drive and similar entries) are non-refundable and non-transferable.

8. CHARGEBACKS AND CARDHOLDER RIGHTS

Cardholder rights. APJGT recognizes and complies with the dispute-resolution rules established by Visa, Mastercard, American Express, Discover, and other card networks. Nothing in our Withdrawal, Refund, and Transfer Policy or in our membership policies is intended to limit or waive a cardholder’s right to dispute charges with the card-issuing bank in accordance with applicable card-brand rules.

Merchant dispute process. If you believe a charge was made in error or you have concerns about a transaction, please contact us first at info@apjgt.com or 407-614-2962 to give us an opportunity to resolve the matter before initiating a chargeback. We may request supporting information to verify your claim.

Evidence submission. If a chargeback is filed, APJGT reserves the right to submit evidence to the cardholder’s issuing bank to demonstrate compliance with our posted policies, including event registration records, proof of participation, written communications, and these Terms.

Excessive chargebacks. Repeated or excessive chargeback activity may result in suspension of services, denial of future registrations, and termination of membership privileges.

9. SMS TERMS

APJGT provides text (SMS) notifications and alerts for events leading up to and on the day of tournaments, authentication codes, and information about upcoming events. By opting in to receive text messages from us (for example, by clicking a box to provide consent), you agree to the following:

  • Wireless carriers are not liable for delayed or undelivered messages.
  • Message and data rates may apply, and message frequency varies by event.

  • You may terminate SMS notifications at any time by replying STOP.
  • Consent to receive text messages is not a condition of registration or participation.

10. CODE OF CONDUCT; TOUR POLICIES

Participation in Tour events is also governed by our Tour Policies, including the Spectator, Caddie, and Player Codes of Conduct, which are incorporated by reference into these Terms. By accepting these Terms, you agree, on behalf of yourself, the Minor, and anyone attending an event as a spectator or caddie for the Minor, to comply with the Tour Policies. APJGT may suspend or remove any participant, spectator, or caddie for violations of the Tour Policies, with or without warning depending on the severity of the violation.

  • frame, mirror, or otherwise incorporate Tournament Data into any other website or service;
  • systematically retrieve Tournament Data to create or compile, directly or indirectly, a collection, compilation, database, or directory; or

We employ technical measures to detect and prevent unauthorized access to and scraping of the Site. Violations of this Section may result in immediate termination of access, legal action, and liability for damages, including lost revenue and costs of enforcement.

12. SITE CONTENT; TRADEMARKS

APJGT and its licensors retain full and complete title to all information and materials provided on or through the Site, including artwork, graphics, text, video and audio clips, trademarks, logos, and other content (together with Tournament Data, “APJGT Content”). “Arnold Palmer,” “Arnold Palmer Junior Golf Tour,” “APJGT,” the APJGT logo, and other marks used on the Site are trademarks of APJGT or its licensors or affiliates and may not be used in connection with the products or services of others in any manner likely to cause confusion. THESE LIMITATIONS DO NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.

17. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless APJGT, ShotStat, their respective affiliates, licensors, and service providers, and each of their respective officers, directors, employees, contractors, agents, licensors, and suppliers, from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to (i) your or the Minor’s participation in the Services, (ii) your Submissions, (iii) your breach of these Terms, or (iv) your violation of any applicable law or the rights of any third party.
